SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION: (all summaries)
Virginia Tort Claims Act; filing of claim where agency alleged to be liable is the Department of Transportation; electronic filing. Provides that, where a claim against the Commonwealth alleges that the Department of Transportation is liable, notice of such claim is to be filed with the Commissioner of Highways. The bill further directs the Commissioner of Highways to promptly deliver notice of such claim to the Attorney General if such claim is outside of any settlement authority delegated to the Department of Transportation by the Attorney General. The bill allows for the electronic filing of tort claims when a filing is made with the Commissioner of Highways.
