SUMMARY AS PASSED: (all summaries)

Admissibility of business records. Provides that in any civil proceeding the authentication and foundation necessary for the admission of a business record under the business records exception to the rule against hearsay may be laid by witness testimony, a certificate of authenticity of and foundation for the record made by the record's custodian or another qualified witness, or a combination of testimony and a certification. The bill also provides that the proponent of the record must give written notice to all other parties no later than 15 days in advance of the trial or hearing if a certification will be relied on for the admission of such record and provide a copy of the record and certification to all other parties. If any party objects to the use of the certification, the authentication and foundation necessary for the admission of the record must be made by witness testimony. This bill as introduced was a recommendation of the Boyd-Graves Conference.
