Be it enacted by the General Assembly of Virginia:

1. § 1. Notwithstanding any contrary provision of law, general or special, no further revenues of the Commonwealth shall be used to support Phase II of the Dulles Corridor Metrorail Project unless the following conditions are met:

1. The Metropolitan Washington Airports Authority (MWAA) implements the imposition and collection of tolls on the Dulles International Airport Access Highway at a rate equal to or greater than that applicable to the Dulles Toll Road, with 100 percent of the tolls collected for use of the Dulles International Airport Access Highway dedicated to the Dulles Toll Road share of Phase II of the Dulles Corridor Metrorail Project capital costs.

2. Fifty percent of any revenue made available to MWAA from nonaviation-related commercial development on federal or MWAA lands in the vicinity of the Virginia Route 606 Rail Station is directed to buy down the share of the Phase II of the Dulles Corridor Metrorail Project funding that is presently being paid with Dulles Toll Road toll revenue.

3. MWAA agrees not to enter into any agreement that would prevent MWAA from transferring Dulles International Airport Access Highway tolls to offset Dulles Toll Road tolls.

4. MWAA agrees not to enter into any agreement that would prevent MWAA from directing 50 percent of any revenue available to MWAA from nonaviation-related commercial development on federal or MWAA lands in the vicinity of the Virginia Route 606 Rail Station to buy down the share of Phase II of the Dulles Corridor Metrorail Project funding that is presently being paid with Dulles Toll Road revenue.
