Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 21.1 of Title 19.2 a section numbered 19.2-368.18:1 as follows:

§ 19.2-368.18:1. Sexual and Domestic Violence Subfund; sexual and domestic violence prevention, intervention, and prosecution.

A. There is hereby created in the state streasury a special subfund of the Criminal Injuries Compensation Fund established pursuant to § 19.2-368.18 to be known as the Sexual and Domestic Violence Subfund and referred to in this section as the "Subfund."

The Subfund shall be established on the books of the Comptroller. All funds (i) directed by general law or through a general appropriation act to be used for sexual and domestic violence prevention, intervention, or prosecution, unless otherwise required by state or federal law to be directed elsewhere, and (ii) any other moneys designated for deposit to the Subfund from any source, public or private, shall be paid into the state treasury and credited to the Subfund. Any moneys remaining in the Subfund at the end of each fiscal year shall not revert to the general fund but shall remain in the Subfund.

B. Moneys in the Subfund shall be used solely for the purposes of sexual and domestic violence prevention, crisis intervention, and prosecution of crimes related to sexual and domestic violence.

C. The Commission shall appoint a Coordinator for Victim Services Funds for Sexual and Domestic Violence to coordinate, administer, and oversee the Subfund. Expenditures and disbursements from the Subfund shall be made by the State Treasurer on warrants issued by the Comptroller upon written request signed by the Coordinator for Victim Services Funds for Sexual and Domestic Violence.
