SUMMARY AS PASSED: (all summaries)

Commonwealth Transportation Board; eminent domain. Prohibits the Commonwealth Transportation Commissioner from exercising eminent domain power to acquire any portion of the property of an existing commercial establishment, or any interest therein, if a purpose of the proposed acquisition is to control or limit access to commercial establishments located within 300 feet of an interstate highway. Designates interstate interchanges as "urban" if the value of land, buildings and improvements has a fair market value of $1 million or more. The bill becomes effective July 1, 2001, unless VDOT receives notice from the federal government that the bill will reduce or jeopardize federal funding. As introduced, the bill was a recommendation of the joint subcommittee studying eminent domain issues. This bill is a duplicate of HB 495.
