Urges Congress to remove § 13612 (a) (C) of the Omnibus Budget Reconciliation Act of 1993, which requires states to make recovery from the estates of persons enjoying enhanced Medicaid asset protection. This resolution notes the benefits of allowing people to become eligible for Medicaid after they exhaust their long-term care insurance benefits and the use of enhanced Medicaid asset protections to motivate citizens to obtain long-term care insurance. Congress is also urged to establish a limited pilot program which exempts Virginia from § 13612 (a) (C) of the Omnibus Budget Reconciliation Act of 1993. Copies will be transmitted to the President of the United Sates, the Speaker of the House of Representatives, and the Congressional Delegation of Virginia.
