SB 1179 Effect of entry of support order in garnishment proceedings.
Introduced by: Phillip P. Puckett | all patrons ... notes | add to my profiles
SUMMARY AS INTRODUCED:
Effect of entry of support order in certain garnishment proceedings. Updates the Code provision allowing garnishments for spousal support or child maintenance when the United States is the third party. Presently, in order to garnish when the United States is liable, there must be a judgment of arrearage and the garnishment lapses after 180 days. The change allows for garnishments to take place when there is a judgment for arrearage, and when there is an order or decree of support for a spouse or for minor children.
