SUMMARY AS INTRODUCED:
Exemplary damages for persons injured by intoxicated drivers. Expands the defendant's scienter requirement, which would be necessary for a finding of willful or wanton behavior in cases involving injury to persons caused by a drunk driver, to include the situation where, following consumption of alcohol, he knew that he was impaired but chose to drive. Currently, the law is limited to the circumstance where, at the time he begins to drink or during his drinking, he knows that he will later drive.
