SUMMARY AS INTRODUCED:
Persons to whom public schools shall be free. Adds to the list of persons deemed to reside in a school division, and therefore entitled to a free public education in the public schools of that division, those individuals whose parents are unable to care for them and who are living, not solely for school purposes, with another person who resides in the school division and is acting in loco parentis pursuant to a legal adoption procedure.
Current law contemplates residency for a variety of cases and addresses children living with a parent by legal adoption as well as for those who are living with a person in loco parentis; however, in the latter case, the child’s parents must be dead.
