SUMMARY AS PASSED:
Public utilities; persons not designated as public utility, public service corporation, etc. Excludes from the definitions of public utility, public service corporation, and public service company any person who owns or operates property and provides electricity, natural gas or water to residents or tenants on the property, if such person (i) purchases such electricity, natural gas or water from a public utility, public service corporation, public service company, municipality or other public body, (ii) only charges the resident or tenant an amount not exceeding such tenant’s or resident’s actual utility charges and does not charge for meter reading, and (iii) maintains three years’ billing records for such charges.
