SUMMARY AS INTRODUCED:

Motor vehicle offenses. Raises the fine for driving while intoxicated and transporting a minor to a minimum of $1,000 and a maximum of $2,000 (currently $100 and $500), as well as makes third DUI offense within ten years a Class 6 felony, with fourth and subsequent offenses carrying a one-year mandatory minimum jail sentence. The bill prohibits the possession of any alcoholic beverage in the passenger area of a motor vehicle upon a public highway, or the right-of-way thereof, in other than the manufacturer’s unopened, original container. A violation of this law is punishable as a Class 4 misdemeanor. The bill also provides that all motor vehicle occupants age sixteen years and up will be required to wear seat belts and law-enforcement officers may not search or inspect a motor vehicle or its contents, the driver or a passenger solely because of a seatbelt violation.
