Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-163.5 as follows:

§ 32.1-163.5. Certification of septic and onsite sewage system design and evaluation by licensed professional engineers.

Notwithstanding other provisions of this chapter, for purposes of permit approval, the Board, Commission and Department of Health shall accept private designs and private evaluations for septic systems and other onsite sewage systems when submitted by a licensed professional engineer who certifies that said systems comply with the Board’s regulations implementing this chapter.
