Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-59.1 as follows:

§ 33.1-59.1. Payment upon approval of break in access control.

Upon approval by the Board of a break in the access control line of a limited access highway requested by the owner of abutting property, the owner shall pay to the Commonwealth an amount equal to the original purchase price or damages paid by the Commonwealth for the extinguishment of the right of access from the affected abutting property onto the limited access highway, together with interest at the legal rate from the date of such original payment, and the costs of providing any safety or operations improvements relating to such break in the access control line necessary for the safety of the traveling public.
