Be it enacted by the General Assembly of Virginia:

1. That § 10.1-2110 of the Code of Virginia is amended and reenacted as follows:

§ 10.1-2110. Local governments outside of Tidewater Virginia may adopt provisions.

A. Any local government, although not a part of Tidewater Virginia, may employ the criteria developed pursuant to § 10.1-2107 and may incorporate protection of the quality of state waters into their comprehensive plans, zoning ordinances and subdivision ordinances consistent with the provisions of this chapter.

B. Any local government may receive financial and technical assistance pursuant to this chapter for employing the criteria developed pursuant to § 10.1-2107 or for developing and implementing a Board-approved voluntary program to incorporate protection of the quality of state waters into their comprehensive plans, zoning ordinances and subdivision ordinances consistent with the provisions of this chapter.
