992508718Be it enacted by the General Assembly of Virginia:
1. That § 56-573.1 of the Code of Virginia is amended and reenacted as follows:
§ 56-573.1. Procurement.
A. The Virginia Public Procurement Act (§ 11-35 et seq.) shall not apply to this chapter; however, a responsible public entity may enter into a comprehensive agreement only in accordance with procedures adopted by it which are consistent with those of § 11-37 to the extent such section applies to the procurement of "other than professional services" through competitive negotiation as defined in §§ 11-37 and 11-48. Such responsible public entities shall not be required to select the proposal with the lowest price offer, but may consider price as one factor in evaluating the proposals received.
B. This chapter shall not apply to contracts for the maintenance of public highways located within a condominium or property owners’ association, as defined in §§ 55-79.41 and 55-509, respectively, which contain 1,000 or more units or lots which have separate ownership when (i) such association seeks to negotiate with the Department of Transportation to perform such maintenance and (ii) the Department of Transportation is satisfied that awarding such contract to a requesting association is in the public interest.
