A BILL to amend the Code of Virginia by adding a section numbered 8.01-40.3, relating to fingerprinting in connection with a business, commercial or financial transaction.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 8.01-40.3 as follows:

§ 8.01-40.3. Fingerprinting in connection with business, commercial or financial transaction.

Whenever any person requires another to furnish a fingerprint or fingerprints in conjunction with any business, commercial or financial transaction, within twenty-one days of the transaction's completion or termination (i) the original record of such prints shall be returned to the person providing such prints and (ii) all copies of such prints, including electronic or facsimile copies, shall be destroyed by the person requiring and obtaining such prints.

The provisions of this section shall not apply in the case of fingerprints affixed to instruments governed by Titles [ 8.3 (§ 8.3-101 8.3A (§ 8.3A-101 ] et seq.) and 8.4 (§ 8.4-101 et seq.).
