Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 12 of Title 18.2 a section numbered 18.2-511, as follows:

§ 18.2-511. Fingerprinting in connection with business, commercial and financial transactions.

A. Whenever any person requires another to furnish a fingerprint or fingerprints in conjunction with any business, commercial or financial transaction, within twenty-one days of the transaction's completion or termination (i) the original record of such prints shall be returned to the person providing such prints and (ii) all copies of such prints, including electronic or facsimile copies, shall be destroyed by the person requiring and obtaining such prints.

B. Any person violating the provisions of this section shall be guilty of a Class 1 misdemeanor.
