991107432Be it enacted by the General Assembly of Virginia:
1. That § 23-174.4 of the Code of Virginia is amended and reenacted as follows:
§ 23-174.4. Composition of board of visitors; appointment, terms, etc.
(a) Until January 31, 1981, the board of visitors shall consist of eleven
members. Thereafter theA. The board of visitors shall consist of thirteen
members.
(b) The who shall be appointed, on or before November 1 of any year in which
their terms shall expire, by the Governor shall appoint the members of the
board of visitors. Members shall be appointed for terms of four years each,
except that the two members initially appointed for terms beginning on February 1, 1981,
to increase the board of visitors to thirteen members shall be appointed for two-year
terms. Of the persons so appointed, at least three shall be alumni of the
University and three may be nonresidents of the Commonwealth; the remaining shall be
appointed at the discretion of the Governor. Vacancies occurring other than by
expiration of term shall be filled by the Governor for the unexpired term.
(c) B. The Governor may appoint alumni visitors from a list of qualified
persons submitted to him upon the recommendation of the alumni association of the University on
or before November 1 of any year in which the terms of such visitors shall
expire. The alumni association shall submit the names of at least three
qualified alumni for such vacancies.
C. All appointments shall be subject to confirmation by the General Assembly.
Members shall continue to hold office until their successors have been appointed and
qualified. Members shall be eligible for two consecutive terms of four years,
(exclusive of that portion of any term on the initial board of less than four years or any
unexpired term).
2. That, for the purpose of providing staggered terms, after the effective date of this act, of the members whose terms shall expire on January 31, 2001, two shall be appointed for terms of three years, three shall be appointed for terms of four years, and two shall be appointed for terms of five years; thereafter, upon expiration of such terms, members shall be appointed to fill such vacancies for terms of four years. In addition, of the members whose terms shall expire on January 31, 2003, three shall be appointed for terms of four years and three shall be appointed for terms of five years; thereafter, upon expiration of such terms, members shall be appointed to fill such vacancies for terms of four years.
