Be it enacted by the General Assembly of Virginia:
1. That § 23-174.4 of the Code of Virginia is amended and reenacted as follows:
§ 23-174.4. Composition of board of visitors; appointment, terms, etc.
(a) Until January 31, 1981, the board of visitors shall consist of eleven
members. Thereafter the board of visitors shall consist of thirteen members.
The board of visitors shall consist of thirteen members to be appointed by the
Governor, three of whom may be nonresidents of the Commonwealth of
Virginia and at least five of whom shall be alumni of Norfolk State University.
(b) The Governor shall appoint the members of the board of visitors. Members
shall be appointed for terms of four years each, except that the two members
initially appointed for terms beginning on February 1, 1981, to increase the board
of visitors to thirteen members shall be appointed for two-year terms (i) four
of the persons appointed to fill terms expiring in 1999 shall be appointed for
four-year terms and three shall be appointed for three-year terms and,
(ii) five of the persons appointed to fill terms expiring
in 2001 shall be appointed for four-year terms and one shall be appointed for a
four-year term and one shall be appointed for a three-year term. Vacancies
occurring other than by expiration of term shall be filled by the Governor for the unexpired term.
(c) The Governor may appoint visitors from a list of qualified persons submitted to him by the alumni association of Norfolk State University, or its titular successor, on or before April 1 of any years in which the terms of any visitors will expire. The alumni association shall submit the names of at least three qualified persons for each vacancy.
(c) (d) All appointments shall be subject to confirmation by the General
Assembly. Members shall continue to hold office until their successors have been appointed and
qualified. Members shall be eligible for two consecutive terms of four years
(exclusive of that portion of any term on the initial board of less than four
years or any unexpired term).
