Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 10.1-1408.3 and 15.2-2281.1 as follows:

§ 10.1-1408.3. Report on site suitability.

At the request of any applicant desiring to site any solid waste management facility as defined in § 10.1-1400 and § 10.1-1454.1, the Board shall develop a report on the impacts such facility located at that site would have on the health, safety and welfare and the natural resources of the Commonwealth. The report shall include a definitive statement either approving or disapproving the site based upon the Board’s assessment of the impacts on health, safety and welfare and the natural resources of the Commonwealth. The report shall be forwarded to the locality for use pursuant to § 15.2-2281.1.

§ 15.2-2281.1. Conditions under which localities may permit solid waste management facilities.

After July 1, 1999, no local zoning ordinance shall allow by right the siting or expansion of any solid waste management facility. A locality may allow the siting or expansion of a solid waste management facility with a special use permit, but such special use permit shall not be issued without the locality first having received from the Virginia Waste Management Board a written report, prepared pursuant to § 10.1-1408.3, indicating that the health, safety and welfare and the natural resources of the Commonwealth can be protected if a solid waste management facility meeting all other requirements of law is sited at the proposed location, and that the Board approves the site.
