Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-195.3:1 as follows:
§ 8.01-195.3:1. Liability for ethnic or racial profiling.
Subject to the provisions of this article, the Commonwealth shall be liable for claims for money only accruing on or after July 1, 1999, on account of any damage, loss or injury caused by a state or local law-enforcement officer or agency for stopping, detaining or interfering with a motorist based upon a racial or ethnic profile. The amount recoverable by any claimant shall not exceed $100,000, exclusive of interest and costs.
The provisions of this article shall be applicable to any county, city or town in the Commonwealth, any local or state law-enforcement departments and any local or state law-enforcement officer.
