Be it enacted by the General Assembly of Virginia:

1. That §§ 2.1-1.7 and 9-6.25:1 of the Code of Virginia are amended and reenacted, and that the Code of Virginia is amended by adding in Title 23 a chapter numbered 16.4, consisting of sections numbered 23-231.19 through 23-231.22, as follows:

§ 2.1-1.7. State councils.

A. There shall be, in addition to such others as may be established by law, the following permanent collegial bodies either affiliated with more than one agency or independent of an agency within the executive branch:

CHAPTER 16.4.
VIRGINIA EDUCATION COORDINATING COUNCIL.

§ 23-231.19. Virginia Education Coordinating Council created.

There is hereby created the Virginia Education Coordinating Council for the purpose of connecting the public and higher education systems in the Commonwealth to facilitate collaboration, dialogue, cooperation, and communication between public schools and institutions of higher education; to provide consistency in policies, goals, and reform efforts; and to ensure the academic success of all students from kindergarten to college, and their preparation for post-collegiate education and lifelong learning.

§ 23-231.20. Membership; terms; vacancies; compensation; officers.

A. The Council shall consist of nine members as follows: the Chairman of the House Committee on Education; one member of the Higher Education Subcommittee of the House Committee on Appropriations, appointed by the Speaker of the House, upon the recommendation of the Chairmen of the House Committee on Appropriations; the Chairman of the Senate Committee on Education and Health; one member of the Public Education Subcommittee of the Senate Committee on Finance, appointed by the Senate Committee on Privileges and Elections, upon the recommendation of the Co-Chairmen of the Senate Committee on Finance; the Secretary of Education; the Chairman of the State Council of Higher Education; the President of the Board of Education; the Director of the State Council of Higher Education; and the Superintendent of Public Instruction.

B. Members shall serve on the Council until the expiration of their terms of office or until their successors shall qualify. However, any vacancy shall be filled in the manner in which the original appointment was made.

C. Legislative members of the Council shall be compensated as specified in § 30-19.12, and all members of the Council shall be reimbursed for their actual expenses incurred in the performance of their duties.

D. The Council shall elect a chairman and a vice chairman from among its members.

§ 23-231.21. Duties and responsibilities; annual report to the Governor and General Assembly.

A. The Council shall meet quarterly and is charged with the responsibility to:

1. Review the governing structure of the public and higher education systems in Virginia, the constitutional and statutory duties of the Board of Education, the statutory responsibilities of the State Council of Higher Education, and other federal and state laws affecting public and higher education.

2. Review K-12 and higher education policies, goals, practices, and reform efforts, including the impact of the requirements of the Standards of Learning and the Standards of Accreditation on public education, and the relevancy of such standards for institutions of higher education in promoting student academic success.

3. Identify and discuss the mutual concerns of public and higher education, and determine ways of encouraging and promoting joint solutions through collaborative ventures and cooperation.

4. Determine and utilize ways to initiate, enhance, and improve communication between members of the public and teachers, administrators, and college faculty and staff.

5. Develop and employ collaborative efforts to increase access and diversity to enhance learning at all levels.

6. Establish measures to promote high quality professional development for all licensed educational personnel and higher education faculty and staff, including pre-service and in-service training, mentorships and support for beginning teachers and college faculty and staff, and faculty-business exchange programs between public schools, institutions of higher education, and the business community.

7. Ascertain and review data on student achievement at the K-12 and college levels to generate recommendations for joint goals for excellence in learning and teaching, and for closing the academic achievement gap between black and white students in the Commonwealth.

8. Convene representatives of the public and higher education communities, parents, policy-makers, and the public to discuss matters of concern to such persons and to facilitate consensus building and resolution to problems.

9. Design and recommend a method to align high school graduation requirements with college admissions requirements, and ensure the continued alignment of such requirements.

10. Monitor innovations and changes designed to improve the delivery of instructional services at all educational levels, encourage joint research and community outreach activities, promote the exchange of information regarding funding and grant opportunities, provide opportunities for networking, and encourage the dissemination of information on best practices.

11. Recommend the need for changes in policy, regulations, or statute identified by the Council in the course of its deliberations which would facilitate cohesiveness, congruity, and consistency in the goals of public and higher education, and which would enable each system to fulfill its respective mission through effective collaboration and cooperation.

The Council shall determine and report the status of education in Virginia for grades PK through 12, and undergraduate, graduate, and professional schools, to the Board of Education, the State Council of Higher Education, the Board for Community Colleges, and the Governor and General Assembly, annually, beginning on December 1, 2000.

§ 23-231.22. Staff; cooperation of state agencies.

The State Council of Higher Education, the Department of Education, and the Division of Legislative Services shall serve as staff to the Council. All agencies of the Commonwealth shall assist the Council upon request.
