Be it enacted by the General Assembly of Virginia:

1. That § 33.1-191 of the Code of Virginia is amended and reenacted as follows:

§ 33.1-191. Contracts.

Every contractor whose bid is accepted shall, before commencing work, enter into a contract with the Commonwealth Transportation Commissioner, which shall fully set out the time when work shall commence and when the contract shall be completed, as well as the time and manner for the payment for the work.

Whenever any duly awarded contract’s cost exceeds the original contract award by more than ten percent because of overruns, add-ons, design changes, or any other occurrence, except (i) labor disputes not caused by the contractor; (ii) riots; (iii) civil commotion or insurrection; (iv) war or warlike operations; (v) governmental restrictions, regulations or control; (vi) inability to obtain any materials or services; (vii) fire or other casualties; (viii) acts of God; or (ix) forces not under the control or supervision of the contractor, then such contract shall be cancelled and the contract shall be rebid in accordance with this chapter.
