Be it enacted by the General Assembly of Virginia:

1. That § 18.2-29 of the Code of Virginia is amended and reenacted as follows:

§ 18.2-29. Criminal solicitation; penalty.

Any If a person who commands, entreats, or otherwise attempts to persuade another person to commit: (i) a felony which is punishable by a term of imprisonment of twenty years or more, he shall be guilty of a Class 5 felony; or (ii) a felony which is punishable by a maximum term of imprisonment of less than twenty years, he shall be guilty of a Class 6 felony. Any If a person age eighteen or older who commands, entreats, or otherwise attempts to persuade another person under age eighteen to commit: (i) a felony which is punishable by a term of imprisonment of twenty years or more, he shall be guilty of a Class 4 felony; or (ii) a felony which is punishable by a maximum term of imprisonment of less than twenty years, he shall be guilty of a Class 5 felony.

2. That the provisions of this act may result in a net increase in periods of imprisonment in state correctional facilities. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $62,500 in FY 2008.
