Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 51.1-163.1 as follows:

§ 51.1-163.1. Survivorship option for husband and wife as participating members.

Upon the death of a member whose spouse is also a member, the surviving spouse shall have the option of electing to receive the death benefit which would have been available to the deceased spouse upon the death of the surviving spouse. Any surviving spouse making an election pursuant to this section shall provide written notice of such election to the Retirement System within ninety days after the death of the member.
