Whereas, in 1980, Campbell B. Slemp was employed by Penn Virginia Resources Corporation as the project director of the Powell River Project; and

Whereas, the Powell River Project was a Virginia Polytechnic Institute and State University (VPI) project dedicated to the economic resource potential of Virginia’s coalfields; and

Whereas, Mr. Slemp held the title of project director until 1993 when he retired from Penn Virginia Resources Corporation; and

Whereas, upon retirement from Penn Virginia Resource Corporation in 1993, Mr. Slemp was employed by VPI and classified as a research associate; and

Whereas, Mr. Slemp actually performed in the capacity of assistant director of the Powell River Project and as director of the Central Appalachian Alliance; and

Whereas, as director of the Alliance, Mr. Slemp was responsible for addressing the economic potential of approximately forty coal producing counties located in Virginia as well as in the states of Kentucky, Tennessee, and West Virginia; and

Whereas, despite the responsibilities of the position, VPI did not change Mr. Slemp’s title of research associate; and

Whereas, on December 12, 1994, Mr. Slemp applied to retire under the Workforce Transition Act; and

Whereas, on July 6, 1995, VPI informed Mr. Slemp that he was ineligible for inclusion because teaching and research faculty were specifically excluded from participation; and

Whereas, Mr. Slemp retired in September of 1995, receiving a monthly retirement benefit of $1,019; and

Whereas, as a result of VPI’s failure to change Mr. Slemp to a more appropriate title based on his duties and responsibilities, he has suffered a loss and will continue to suffer a monthly loss of $1,287; and

Whereas, Campbell B. Slemp has no other means of relief except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That [ there is hereby allocated from the funds appropriated to the Virginia Retirement System (VRS) monthly payments of $1,287 beginning in August of 1999 for the relief of Campbell B. Slemp. These amounts shall be paid by check issued by the State Treasurer on a warrant issued by the Comptroller, upon execution by Campbell B. Slemp of a release of all claims he may have against the Commonwealth or any of its political subdivisions or their officers, employees, or agents. In addition, VPI shall (i) approve Campbell B. Slemp’s participation in the Workforce Transition Act (WTA) by providing two WTA credits and (ii) pay VRS the appropriate sums to cover the costs of the credits. Virginia Polytechnic Institute and State University is hereby directed to provide relief to Mr. Campbell B. Slemp by retroactively classifying his position as assistant director of the Powell River Project thereby making him eligible for the Workforce Transition Act (WTA) as he requested on December 12, 1995. Upon reclassification and execution by Campbell B. Slemp of a release of all claims he may have against the Commonwealth or any of its political subdivisions or their officers, employees or agents, VPI shall provide two WTA credits and transfer appropriate sums to the Virginia Retirement System to cover the costs of the credits. ]
