999202376Be it enacted by the General Assembly of Virginia:
1. That § 8.01-225.2 of the Code of Virginia is amended and reenacted as follows:
§ 8.01-225.2. Immunity for those rendering emergency care to animals.
A. Any person, including a person licensed to practice veterinary medicine, who in good faith and without compensation renders emergency care or treatment to an injured animal at the scene of an emergency or accident shall not be liable for any injuries to such animals resulting from the rendering of such care or treatment.
B. Wildlife rehabilitators permitted by the Department of Game and Inland Fisheries and volunteers working under their direct supervision who, without compensation, render assistance or advice relating to wildlife that is orphaned, injured or, because of its location, in danger of injury from anything other than lawful hunting, shall not be liable for civil damages for any act or omission resulting from the rendering of such assistance or advice unless such act or omission was the result of gross negligence or willful misconduct. The immunity conferred by this subsection shall apply whether the assistance or advice was rendered in person, by telephone, or by other means of communication.
