An Act to amend and reenact § 23-174.4 of the Code of Virginia, relating to the Board of Visitors of Norfolk State University.

Be it enacted by the General Assembly of Virginia:

1. That § 23-174.4 of the Code of Virginia is amended and reenacted as follows:

§ 23-174.4. Composition of board of visitors; appointment, terms, etc.

(a) A. Until January 31, 1981, the board of visitors shall consist of eleven members. Thereafter The board of visitors shall consist of thirteen members.

(b) who shall be appointed, on or before January 31 of any year in which their terms shall expire, by the Governor shall appoint the members of the board of visitors. Members shall be appointed for terms of four years each, except that the two members initially appointed for terms beginning on February 1, 1981, to increase the board of visitors to thirteen members shall be appointed for two-year terms. Vacancies occurring other than by expiration of term shall be filled by the Governor for the unexpired term.

(c) B. All appointments shall be subject to confirmation by the General Assembly. Members shall continue to hold office until their successors have been appointed and qualified. Members shall be eligible for two consecutive terms of four years, (exclusive of that portion of any term on the initial board of less than four years or any unexpired term).

2. That, for the purpose of providing staggered terms, after the effective date of this act, of the members whose terms shall expire on January 31, 2003, two shall be appointed for terms of three years, three shall be appointed for terms of four years, and two shall be appointed for terms of five years; thereafter, upon expiration of such terms, members shall be appointed to fill such vacancies for terms of four years. In addition, of the members whose terms shall expire on January 31, 2001, three shall be appointed for terms of four years and three shall be appointed for terms of five years; thereafter, upon expiration of such terms, members shall be appointed to fill such vacancies for terms of four years.
