CHAPTER 907
An Act to amend and reenact §§ 46.2-742.1, 46.2-743, 46.2-746.7, 46.2-746.8, and 46.2-749.4 of the Code of Virginia; to amend the Code of Virginia by adding sections numbered 46.2-746.2:1 and 46.2-746.2:2 and by adding in Article 10 of Chapter 6 of Title 46.2 sections numbered 46.2-749.12 through 46.2-749.26; and to repeal § 46.2-746.2 of the Code of Virginia, relating to special license plates; fees.

Be it enacted by the General Assembly of Virginia:

1. That §§ 46.2-742.1, 46.2-743, 46.2-746.7, 46.2-746.8, and 46.2-749.4 of the Code of Virginia are amended and reenacted and that the Code of Virginia is amended by adding sections numbered 46.2-746.2:1 and 46.2-746.2:2 and by adding in Article 10 of Chapter 6 of Title 46.2 sections numbered 46.2-749.12 through 46.2-749.26 as follows:

§ 46.2-742.1. Special license plates for persons awarded the Bronze Star, Bronze Star with a “V” for valor, or the Silver Star; fee.

On receipt of an application and written evidence that the applicant has been awarded a Bronze Star, Bronze Star with a “V” for valor, or Silver Star Medal, the Commissioner shall issue to the applicant special license plates.

For each set of license plates issued under this section, the Commissioner shall charge, in addition to the prescribed cost of state license plates, a one-time fee of ten dollars at the time the plates are issued.

The provisions of subdivisions 1 and 2 of subsection B of § 46.2-725 shall not apply to license plates issued under this section.

§ 46.2-743. Special license plates for certain veterans.

A. On receipt of an application and written evidence that the applicant is an honorably discharged former member of one of the armed forces of the United States, the Commissioner shall issue to the applicant special license plates.

B. On receipt of an application and written evidence that the applicant is an on active duty with, has been honorably discharged after at least six months of active duty service in, or has retired member of from the United States Army, Navy, Air Force, or Marine Corps, the Commissioner shall issue to the applicant special license plates whose design incorporates an emblem of the military service of which the applicant is an active duty or retired member.

C. On receipt of an application and written evidence that the applicant is a veteran of World War II, the Commissioner shall issue special license plates to veterans of World War II.

D. On receipt of an application and written evidence that the applicant is a veteran of the Korean War, the Commissioner shall issue special license plates to veterans of the Korean War.

E. On receipt of an application and written evidence that the applicant is a veteran of the Vietnam War, the Commissioner shall issue special license plates to veterans of the Vietnam War.

F. On receipt of an application and written evidence that the applicant is a veteran of Operation Desert Shield or Operation Desert Storm, the Commissioner shall issue special license plates to veterans of those military operations.

G. The provisions of subdivisions 1 and 2 of subsection B of § 46.2-725 shall not apply to license plates issued under subsection A, C, D, or E of this section.

§ 46.2-746.2:1. Special license plates; members of the 82nd Airborne Division Association.

On receipt of an application therefor and presentation of written evidence that the applicant is a member of the 82nd Airborne Division Association, the Commissioner shall issue to the applicant special license plates.

§ 46.2-746.2:2. Special license plates; members of the Society of the 173rd Airborne Brigade.

On receipt of an application therefor and presentation of written evidence that the applicant is a member of the Society of the 173rd Airborne Brigade, the Commissioner shall issue to the applicant special license plates.

§ 46.2-746.7. Special license plates for members of certain civic and fraternal organizations.

On receipt of an application and written evidence that the applicant is a member of such organization, the Commissioner shall issue special license plates to members of the following organizations: the Exchange Club, the Jaycees, the Kiwanis, the Lions of Virginia, the Loyal Order of Moose, Ruritan National, the Virginia Future Farmers of America Association, the Freemasons, the Shriners, the Most Worshipful Prince Hall Grand Lodge of Virginia, the Order of the Eastern Star, the Knights of Columbus, and college and university fraternities and sororities.

§ 46.2-746.8. Special license plates for members of certain occupational associations.

On receipt of an application and written evidence that the applicant is a member of such organization, the Commissioner shall issue special license plates to members of the following organizations: the National Society of Black Engineers, the Communications Workers of America, the Virginia Sheriffs' Association, the Fraternal Order of Police, the International Association of Firefighters, the Virginia State Firefighters Association, the State Fire Chiefs Association of Virginia, the Association of Realtors, and the Society of Certified Public Accountants.

§ 46.2-749.4. Special license plates bearing the seal, symbol, emblem, or logotype of certain localities.

On receipt of a minimum of 350 paid applications therefor, the Commissioner may design and issue special license plates whose design incorporates the seal, symbol, emblem, or logotype of any county or, city or town.

The annual fee for plates issued pursuant to this section shall be twenty-five dollars plus the prescribed fee for state license plates. For each such twenty-five-dollar fee collected in excess of 1,000 registrations pursuant to this section, fifteen dollars shall be paid to the locality whose seal, symbol, emblem, or logotype appears on the plate. These funds shall be paid to the affected localities annually and may be used as provided by the local governing body.

§ 46.2-749.12. Special license plates; supporters of the Chincoteague Pony Association.

On receipt of an application therefor, the Commissioner shall issue special license plates to supporters of the Chincoteague Pony Association.

§ 46.2-749.13. Special license plates; Internet commerce industry.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates designed to represent the Internet commerce industry.

§ 46.2-749.14. Special license plates; supporters of greyhound adoption programs.

On receipt of an application therefor, the Commissioner shall issue special license plates to supporters of greyhound adoption programs.

§ 46.2-749.15. Special license plates; Eagle Scouts.

On receipt of an application therefor and presentation of written evidence that the applicant is an Eagle Scout, the Commissioner shall issue to the applicant special license plates bearing the legend: EAGLE SCOUT.

§ 46.2-749.16. Special license plates; members of the Navy League of the United States.

On receipt of an application therefor and presentation of appropriate written evidence that the applicant is a member of the Navy League of the United States, the Commissioner shall issue special license plates to the applicant.

§ 46.2-749.17. Special license plates; members of the Order of AHEPA.

On receipt of an application therefor and receipt of appropriate written evidence that the applicant is a member of the Order of AHEPA, the Commissioner shall issue special license plates to the applicant.

§ 46.2-749.18. Special license plates; horse enthusiasts.

On receipt of an application therefor, the Commissioner shall issue special license plates to horse enthusiasts.

§ 46.2-749.19. Special license plates; supporters of public schools.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue to the applicant special license plates bearing the legend: HELPING SCHOOLS.

B. The annual fee for plates issued pursuant to this section shall be twenty-five dollars in addition to the prescribed fee for state license plates. For each such twenty-five-dollar fee collected in excess of 1,000 registrations pursuant to this section, fifteen dollars shall be paid into the state treasury and credited to a special nonreverting fund known as the Helping Schools Fund, established within the Department of Accounts. These funds shall be paid annually to the school division of the locality in which the vehicle is registered and used for the purchase of classroom supplies and equipment in grades K through 12.

§ 46.2-749.20. Special license plates; members of the Virginia State Police Alumni, Inc.

On receipt of an application and presentation of written evidence that the applicant is a member of the Virginia State Police Alumni, Inc., the Commissioner shall issue special license plates to members of the Virginia State Police Alumni, Inc.

§ 46.2-749.21. Special license plates; Hampton Roads.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates bearing the legend: HAMPTON ROADS.

§ 46.2-749.22. Special license plates; public safety communications professionals.

On receipt of an application and appropriate written evidence signed by a chief law-enforcement officer, fire chief, or public safety administrator, that the applicant is a public safety communications professional, the Commissioner shall issue special license plates to the applicant.

§ 46.2-749.23. Special license plates; Virginia is for lovers.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates bearing the legend: VIRGINIA IS FOR LOVERS.

§ 46.2-749.24. Special license plates celebrating the history of Fairfax County.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue to the applicant special license plates celebrating the history of Fairfax County.

B. The annual fee for plates issued pursuant to this section shall be twenty-five dollars in addition to the prescribed fee for state license plates. For each such twenty-five-dollar fee collected in excess of 1,000 registrations pursuant to this section, fifteen dollars shall be paid into the state treasury and credited to a special nonreverting fund known as the Fairfax County Historical Preservation Fund, established within the Department of Accounts. These funds shall be paid annually to Fairfax County to assist in historic preservation activities and programs within the County.

§ 46.2-749.25. Special license plates commemorating the 300th anniversary of the City of Falls Church.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 300th anniversary of the City of Falls Church.

The provisions of this section shall expire on July 1, 2004.

§ 46.2-749.26. Special license plates; Natural Bridge of Virginia.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates celebrating the Natural Bridge of Virginia.

2. That § 46.2-746.2 of the Code of Virginia is repealed.
