CHAPTER 300
An Act to amend and reenact §§ 2.2, 3.5 and 4.5 of Chapter 136 of the Acts of Assembly of 1988, which provided a charter for the Town of Dayton, and to repeal the third enactment of Chapter 713 of the Acts of Assembly of 1998, relating to town powers, election of council, and the office of recorder.

Be it enacted by the General Assembly of Virginia:

1. That §§ 2.2, 3.5 and 4.5 of Chapter 136 of the Acts of Assembly of 1988 are amended and reenacted as follows:

§ 2.2. Adoption of powers granted by the General Assembly.

In addition to the powers in § 2.1 of this charter the town is granted, but not limited to, all powers set forth in Chapter 9 (§ 15.2-900 et seq.) and Chapter 11 (§ 15.2-1100 et seq.) of Title 15.2 of the Code of Virginia, 1950, §§ 15.1-837 through 15.1-907, both inclusive, including subsequent amendments and recodifications thereof.

§ 3.5. Election of mayor and members of council.

The mayor and members of council shall be elected by the qualified voters of the town in the manner provided by law from the town at large. The council and mayor in office at the time of the adoption of this charter shall continue in office until the expiration of the terms for which they were elected or until their successors are elected and qualified. The term of office for members of the council shall be four years, and the term of office for the mayor shall be two years, or until their successors are elected and qualified. Thus an election for four council members and the mayor shall be held in 1988 2000, and an election for the remaining three council members and the mayor shall be held in 1990 2002. All elections of the mayor and council members shall take place on the first Tuesday of May after the first Monday in November. Persons elected under this section in May 1988 and May 1990, shall take office on September January 1 following their election. Thereafter, persons elected under this section shall take office on July 1 following their election.

§ 4.5. Recorder.

Under the town's previous charter, the office of recorder was an elected position, and the current term for that office expires on September 1, 1988. Until and including September 1, 1988, the office of recorder shall have the duties and powers specified in the charter in effect immediately preceding the enactment of this charter. Beginning September 2, 1988, the office of recorder shall become an appointed office subject to the provisions of this chapter, with such duties as the council may prescribe. The council may appoint a recorder whose duties shall be prescribed by the council.

2. That the third enactment of Chapter 713 of the Acts of Assembly of 1998 is repealed.
