CHAPTER 143 An Act to amend and reenact § 3.02 as amended of Chapter 227 of the Acts of Assembly of 1954, which provided a charter for the City of Covington, relating to vacancies in office. [S 814] Approved March 17, 1999

Be it enacted by the General Assembly of Virginia:

1. That § 3.02 as amended of Chapter 227 of the Acts of Assembly of 1954 is amended and reenacted as follows:

§ 3.02. Vacancies in Office of Councilman.

Vacancies in the office of councilman, from whatever cause arising, shall be filled for the unexpired portion of the term by majority vote of the remaining members of the council, except that, if the unexpired portion of the term at the time the vacancy occurs is thirty months or more, the appointment shall run only through the last day of June following the next regular municipal election, at which election the vacancy for the remaining portion of the term shall be filled. The person so elected shall qualify and take office July 1 following his election. If the council shall fail to act within sixty days of the occurrence of the vacancy it shall be filled by appointment of the Circuit Court of Alleghany County, in accordance with § 24.1-76 of the Code of Virginia in accordance with the general laws of the Commonwealth of Virginia.
