SUMMARY:
Attorney-issued summonses and subpoenas. Authorizes attorneys to issue summonses, subpoenas and subpoenas duces tecum in pending civil litigation. Exceptions are provided for habeus corpus, civil abuse and neglect, forfeiture, habitual offender and other civil proceedings which have a quasi-criminal component. Subpoenas duces tecum for medical records must comply with other statutory provisions (Patient Health Records Privacy) added last year.
The bill is recommended by the Boyd-Graves Conference.
