HB 634 Restoration of privilege to drive after license revoked.

Introduced by: Ward L. Armstrong | all patrons    ...    notes | add to my profiles

SUMMARY:

Restoration of privilege after driving while license revoked or suspended. Requires that notice of a petition for restoration of driving privilege be given to the attorney for the Commonwealth and to the Commissioner of DMV who is to make a determination whether the person may be ineligible for restoration. A hearing on the petition may not be set for earlier than 30 days from the date the petition was filed. The Commissioner of DMV is authorized to give notice of the filing of a petition to the Attorney General, who is then authorized to participate in the proceedings on behalf of the Commonwealth.

The court is authorized to require the petitioner to be assessed by VASAP.

The bill clarifies that a petition for restoration may not be made prior to five years after loss of driving privileges if loss of privileges was based in part on a DUI conviction.

The bill also corrects an inadvertent omission of the word "adjudication" in the Habitual Offender statute.

This bill is recommended by the Commission on VASAP.
