SUMMARY:
State grievance procedures; award of attorneys' fees. Changes the basis for awarding attorneys' fees in suits to implement the decision of a hearing officer related to a grievance. Under the bill, if either party substantially prevails on the merits of the case and the other party's position is not substantially justified, attorneys' fees must be awarded unless special circumstances would make an award unjust. Current law allows for the award of attorneys' fees to either party in the discretion of the court.
