SUMMARY:
Criminal cases. Establishes uniform scheduling requirements for criminal cases. Subject to limited exceptions for specified delays, every felony case must be set for trial no earlier than 45 days from the date on which the defendant first appeared through counsel or waived counsel and no later than 120 days from the filing of the information or indictment or the date the defendant appeared before a judicial officer, whichever is later.
The bill is modeled after the federal speedy trial provisions (18 U.S.C. § 3161), but the time limits specified are within the limits of Virginia's speedy trial law (§ 19.2-243).
