Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 10.1-1186.1:1 as follows:

§ 10.1-1186.1:1. Reporting of malfunctions; posting on Internet.

A. Those owning or operating any facility, source or establishment with permits regulating air pollution emissions or water pollution discharges shall report to the Department malfunctions as that term is defined in State Air Pollution Control Board and State Water Control Board regulations. The reports, in addition to other information that the State Air Pollution Control Board or the State Water Control Board may require, shall include: the location of the facility; a description of the malfunction; the duration of the malfunction; the time of malfunction; estimated or actual emissions or discharges due to the malfunction; and any known causes for the malfunction. The two Boards shall develop standard forms for the submission of malfunction information.

B. The Department shall create at its web site a location where the information submitted pursuant to subsection A may be viewed and searched by the public. The information shall be searchable by, at a minimum, facility name and location. Information shall be retained at the web site for a period of at least two years from original posting.
