Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.1-51.14:01 as follows:

§ 2.1-51.14:01. Deputy Secretary for Long-term Care established; appointment; term; oath; duties.

A. The position of Deputy Secretary of Health and Human Resources for Long-term Care, hereinafter referred to as the Deputy Secretary, is hereby created. The Deputy Secretary shall be an individual with expertise and experience in long-term care policy, and shall be appointed by the Governor, subject to confirmation by the General Assembly if in session when the appointment is made, and if not in session, then at its next succeeding session. The Deputy Secretary shall hold office at the pleasure of the Governor for a term coincident with that of the Governor making the appointment or until a successor shall be appointed and qualified. Before entering upon the discharge of his duties, the Deputy Secretary shall take an oath to faithfully execute the duties described in subsection B.

B. The Deputy Secretary shall have the following responsibilities:

1. Coordinate the work of state agencies to implement the long-term care policy of the Commonwealth as expressed by the General Assembly;

2. Develop and update annually, in consultation with the Department for the Aging and other appropriate entities, a five-year plan for financing long-term care services for the elderly and frail elderly in the Commonwealth; and

3. Perform such other duties as may be assigned by the Governor or the Secretary of Health and Human Resources.
