A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 31 of Title 58.1 a section numbered 58.1-3122.2 and by adding in Article 2 of Chapter 31 of Title 58.1 a section numbered 58.1-3172.1, relating to online public access to nonconfidential public records maintained by commissioners of the revenue and treasurers.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 31 of Title 58.1 a section numbered 58.1-3122.2 and by adding in Article 2 of Chapter 31 of Title 58.1 a section numbered 58.1-3172.1 as follows:

§ 58.1-3122.2. Remote access to nonconfidential public records maintained by commissioner.

The commissioner of the revenue may provide remote access, including without limitation, Internet access, to all nonconfidential public records maintained by his office, subject to such limitations as may be imposed by general law. Any system of remote access created or maintained pursuant to the provisions of this section shall include security measures that preclude remote access users from (i) obtaining any data that is required to be maintained as confidential pursuant to § 58.1-3 or other applicable law, and (ii) modifying or destroying any record or data in any manner.

§ 58.1-3172.1. Remote access to nonconfidential public records maintained by treasurer.

The treasurer may provide remote access, including without limitation, Internet access, to all nonconfidential public records maintained by his office, subject to such limitations as may be imposed by general law. Any system of remote access created or maintained pursuant to the provisions of this section shall include security measures that preclude remote access users from (i) obtaining any data that is required to be maintained as confidential pursuant to § 58.1-3 or other applicable law, and (ii) modifying or destroying any record or data in any manner.
