987291208Be it enacted by the General Assembly of Virginia:
1. That § 29.1-744.2 of the Code of Virginia is amended and reenacted as follows:
§ 29.1-744.2. Local regulation of motorboat distance; penalty.
A. Any county, city, or town which is adjacent to an inland lake wholly
located within the Commonwealth that (i) is more
than 500 feet above sea level and (ii) of 20,000 acres or more
and wholly located within the Commonwealth in size or (ii)
lies adjacent to any county with a population
between 57,300 and 57, 450; any county with a population between 21,000, and
21,500; and any county with a population between 20,000
and 20,600, may, by ordinance, require motorboats equipped with engines
above twenty horsepower to remain below planing speed while within 50 feet or
less of the shore or docks attached to the shore, provided that the maximum
restricted distance from any shore shall not exceed 75 feet. Any such
ordinance shall not become effective until all counties, cities, or towns
adjacent to the inland lake have adopted the identical ordinance. For the
purpose of this section, motorboat shall be defined as in § 29.1-700.
B. Any such ordinance adopted by a county, city, or town may provide for penalties not exceeding those applicable to Class 4 misdemeanors.
C. Any such ordinance adopted by a locality shall be enforced by the Department of Game and Inland Fisheries or other state and local law-enforcement agencies or departments.
