Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-878.3 as follows:

§ 46.2-878.3. Maximum speed limits in vicinity of highway accidents and similar incidents; penalty.

The maximum lawful speed for any motor vehicle operating in the vicinity of a highway or roadside accident or similar highway or roadside incident shall be twenty miles per hour less than the speed limit otherwise applicable to motor vehicles at such location. The provisions of this section shall only apply to accidents and incidents where law-enforcement officers, firefighters, ambulance or rescue squad personnel, or other persons responding to the accident or incident are present, and the area to which the reduced speed limit applies is indicated by traffic cones, flares, flags, flashing or steady-burning warning lights or arrows, or computerized message signs. Violation of the reduced speed limit provided for in this section shall constitute a traffic infraction punishable by a fine of not more than $250.

Nothing in this section shall preclude a prosecution or conviction for reckless driving of any motor vehicle operator whose operation of any motor vehicle in the vicinity of a highway or roadside accident or incident, apart from speed, demonstrates a reckless disregard for life, limb, or property.
