Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-57.1:1 as follows:

§ 18.2-57.1:1. Disarming a law-enforcement officer; penalty.

Any individual who knows or has reason to know a person is a law-enforcement officer and who, while such officer is acting within the scope of his duties, with the intent to impede or prevent the officer from performing his duties and without the permission of the officer, knowingly removes a firearm from the possession of the officer or deprives the officer of the use of the firearm is guilty of a felony punishable by a term of imprisonment of not less than five nor more than ten years which term shall be served consecutively with any other term of imprisonment.

2. That the provisions of this act may result in a net increase in periods of imprisonment in state correctional facilities. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $250,000.
