An Act to amend and reenact § 37.1-3 of the Code of Virginia, relating to membership on the State Mental Health, Mental Retardation and Substance Abuse Services Board.

Be it enacted by the General Assembly of Virginia:

1. That § 37.1-3 of the Code of Virginia is amended and reenacted as follows:

§ 37.1-3. Creation of Board; appointment of members; terms and vacancies.

There shall be a State Mental Health, Mental Retardation and Substance Abuse Services Board which shall consist of nine members to be appointed by the Governor, subject to confirmation by the General Assembly, if in session when such appointment is made, and if not in session, then at its next succeeding session. No less than one-third of the members shall be consumers of mental health, mental retardation or substance abuse services or family members of consumers of such services. At all times at least one member shall be a consumer and, one shall be a family member of a consumer, and one shall be an elected local government official. Appointments shall be made for terms of four years each, except appointments to fill vacancies which shall be for the unexpired terms. No person shall be eligible to serve more than two successive full four-year terms; however, persons heretofore and hereafter appointed to fill vacancies may serve two additional full four-year terms. No person shall serve more than a total of twelve years.
