CHAPTER 221 An Act to amend the Code of Virginia by adding a section numbered 15.2-2245.1, relating to subdivision ordinances. [H 113] Approved April 2, 1998

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-2245.1 as follows:

§ 15.2-2245.1. Stormwater management ponds; removal of trees.

A locality shall not require, but may permit, the removal of trees to create stormwater management ponds or facilities if the minimum adequate outfall requirements and the requirements of the Chesapeake Bay Preservation Act (§ 10.1-2100 et seq.) can otherwise be met.
