No county, city or town may increase its nominal tangible personal property tax rate above the rate existing on August 1, 1997 unless the increased rate is approved in a local referendum by two-thirds of the voters voting in a referendum held within the locality in accordance with Article 5 of Chapter 6 of Title 24.2. The referendum shall be initiated by resolution of the local governing body. The clerk of the circuit court shall publish notice of the election in a newspaper of general circulation in the locality once a week for three consecutive weeks prior to the election.
