That an emergency exists and the provisions of this act shall become effective on the first to occur of (i) July 1, 1998, or (ii) the first day of the third month following the date that the Board of Trustees of the Virginia Retirement System obtains a ruling from the Internal Revenue Service that affirmatively states that the provisions of this act do not affect the status of the retirement system as a qualified plan for federal income tax purposes.
