That the Department of Medical Assistance Services shall submit and seek approval of a waiver from the federal Health Care Financing Administration (HCFA) to charge premiums and co-payments on a sliding scale for children whose family income is above 150 percent of the federal poverty level. Should the waiver not be approved by HCFA, the Department of Medical Assistance Services shall submit a Title XXI plan using Medicaid income methodologies and Medicaid benefits, but which charges premiums and co-payments on a sliding fee scale for children whose family income is above 150 percent of the federal poverty level.
