SUMMARY:
Zoning violations. Provides that if a zoning violation is uncorrected at the time of conviction, the court shall order the abatement of the violation within a specified time and that failure to abate the violation will constitute a separate offense for each succeeding 30-day period. This is in response to a recent Virginia Court of Appeals decision in which the court held that localities do not currently have the authority to provide in their local ordinances that each day of a continuing zoning violation shall constitute a separate offense. This bill is identical to HB 2088.
