SUMMARY:
Punitive damages; driving under the influence. Provides that proof that the defendant was (i) an adjudicated habitual offender on the basis of an offense involving alcohol or drugs and (ii) driving while his license was suspended or revoked as a result of the adjudication, is evidence that the defendant's actions were sufficiently willful and wanton as to allow for an award of exemplary damages in an action for injuries or death arising out of the defendant's operation of a motor vehicle.
