SUMMARY:

Procedures for resolving certain special education disputes. Directs the Board of Education, in its procedures governing the resolution of disputes in special education, to encourage the use of mediation. Currently, to ensure eligibility for federal funding, the Board of Education must establish procedures affording parents and pupils due process in resolving disputes regarding special education placements, tuition eligibility, and individualized education programs; final decisions in these due process proceedings may be appealed to the appropriate circuit court. The measure specifically notes that mediation will not be used to deny or delay the due process rights of parents or guardians.
