SUMMARY:

Freedom of Information; access by persons incarcerated. Provides that the Freedom of Information Act shall not be construed to afford any rights to any person incarcerated in a state, local or federal correctional facility, whether or not such facility is (i) located in the Commonwealth and (ii) operated pursuant to the Corrections Private Management Act (§ 53.1-261 et seq.). The bill does not prevent incarcerated persons from exercising their constitutional rights, including calling for evidence in their favor in a criminal prosecution. The bill attempts to halt the abuse of FOIA requests made by inmates.
